Evermore Ridge Guest Policies & Liability Waiver

Please review our policies and liability waver. Signing below indicates your understanding and agreement with all policies and Evermore Ridge LLC Liability Waiver

Guests, invitees, and vendors are prohibited from the following: •Removing Evermore Ridge LLC decor, floral, or greenery without permission of Evermore Ridge staff. •Using tape, adhesives of any kind, tacks, nails, or staples on the walls, floor, door, tables, arch, etc. •Peeing anywhere on Evermore Ridge LLC property other than designated restrooms •Entering the lounge or suite (rooms where the bride and groom are preparing for their event); the lounge and suite are limited to the wedding party and close family that the bride/groom invites in the lounge and suite. •Dumping floral or greenery on Evermore Ridge LLC property.

Evermore Ridge LLC prohibits the use of the following items: •Real Candles •Fireworks (sparklers may be used outside only) •Glitter/Confetti or any like item •Silly string •Crayons, markers, or any like item. •Smoke machines/bombs •Chinese lanterns •Thrown petals must be a light color, or concrete can be stained

Safety & Supervision Smoking Evermore Ridge LLC allows smoking only in designated smoking areas. This includes cigarettes, cigars, e-cigarettes/vape pens, etc. If guests are found smoking and not utilizing the proper designated smoking area, Evermore Ridge LLC and its employees will require the person to leave the property. If cigarette butts are found anywhere other than designated cigarette butt containers, this will be considered littering and an extra clean up fee will be charged to the CLIENT.

Safety & Supervision Alcohol Evermore Ridge LLC has a "no shot" policy. If this policy is not followed, Evermore Ridge LLC staff will ask the person to leave Evermore Ridge LLC property. As the guest of a private party, the guest acknowledges responsibility for the proper and lawful consumption of alcoholic beverages at Evermore Ridge LLC during the duration of the event they attend at Evermore Ridge LLC. All guests at Evermore Ridge LLC agree to fully cooperate and assist in enforcing the laws of the State of West Virginia and the policies of Evermore Ridge LLC regarding the consumption of alcoholic beverages.

Safety & Supervision Children Children must be supervised at all times. If children are found unsupervised, the child and their respective guardian will be asked to leave Evermore Ridge LLC property. Children are not to be in any space, including the suite and the lounge, unattended. Children should not use steps of any kind without the assistance of an adult. Children should not pick any flowers or greenery on Evermore Ridge LLC property (to include flowers from the wildflower field). Children should not throw or relocate gravel, stones or rocks on Evermore Ridge LLC property. Children should not climb or sit on rocks behind ceremony arch or stone pillars on the patio. Children should not jump, stand or climb on benches or chairs. These are safety hazards and Evermore Ridge LLC is not responsible for any injuries.

Children Animals The only animals authorized on Evermore Ridge LLC property are animals that have been pre approved by Evermore Ridge LLC staff. The only exception to this rule is for designated service animals. All approved animals must be harnessed, leashed, tethered or in a carrier at all times, this includes service animals unless the devices interfere with the service animal’s work or if the individual’s disability prevents using these devices. No animals are allowed inside or on the patio of Evermore Ridge LLC reception space, unless the animal is a designated service animal. Emotional support, therapy, comfort, or companion animals are not considered service animals and are not permitted inside the reception area or on the patio connected to the building. All animals, brought by guests, are the full responsibility of the guest and the guest, hereby waives on its behalf all claims and demands against Evermore Ridge LLC for any such loss, damage, or injury caused by any animals and hereby agrees to indemnify and hold Evermore Ridge LLC free and harmless from all liability for any such loss, damage or injury to other persons, and from all costs and expenses arising there from, including but not limited to attorney fees. If a service animal is present, Evermore Ridge LLC reserves the right to ask: (1) is the dog a service animal required because of a disability, and (2) what work or task has the dog been trained to perform? Evermore Ridge LLC can ask a person with a disability to remove the service animal from the premises if the service animal is out of control and the handler does not take effective action to control it or if the animal is not housebroken. Any damage caused by an animal brought by a guest is the full responsibility of the guest who is responsible for the animal and the CLIENT who signed the contract for the event. All animal feces are the responsibility of the guest responsible for the animal and/or CLIENT and must be picked up and properly disposed of in the trash. There will be a charge of $50 if animal feces is not picked up. There will also be a charge to replace or fix any damages caused by the animal.

Entertainment & Release of Media Media Evermore Ridge LLC will request all professional photographs and videos from vendors (photographer, videographer, etc.) hired by CLIENT. If given permission by the CLIENTS hired vendors, Evermore Ridge LLC reserves the right to view and use any professional photographs and videos for promotional and marketing purposes, unless otherwise stated by the CLIENT in writing. Evermore Ridge LLC staff may also take their own photographs and videos for Evermore Ridge LLC use. This includes but is not limited to use of photographs and videos on all Evermore Ridge LLC social media platforms and the Evermore Ridge LLC website. By agreeing to this waiver, guests agree and understand photographs and videos taken by Evermore Ridge LLC staff and the professional photographs and videos from the CLIENTs wedding/event and can be used by Evermore Ridge LLC with the permission of the CLIENTs hired vendors.

Music The proximity of local residences to Evermore Ridge LLC is such that venue sounds, specifically sound related to music, must be kept below certain levels. Evermore Ridge LLC reserves the right to ask the CLIENT or hired vendor performing music to turn the volume down. Evermore Ridge LLC reserves the right to close the doors to the venue to decrease the projection of sound. All music must end 1 hour prior to the end of the event.

Waiver of Liability: Evermore Ridge LLC does not accept any responsibility for damage to or loss of any articles or property left at Evermore Ridge LLC prior to, during or after the event. The guest agrees to be responsible for any damage done to Evermore Ridge LLC by them. Further, Evermore Ridge LLC shall not be liable for any loss, damage or injury of any kind or character to any person or property caused by or arising from any act or omission of any guests, invitees, and employees from any accident or causality occasioned by the failure of the CLIENT to maintain the premises in a safe condition or arising from any other cause. It is the responsibility of guests, invitees, and employees to keep all children safe. Children under the age of 16 should be supervised by an adult at all times. Guests, invitees, and employees are not permitted to enter or exit Evermore Ridge LLC through any windows. Guests, as a material part of the consideration of this agreement, hereby waives on its behalf all claims and demands against Evermore Ridge LLC for any such loss, damage, or injury of the guest, and hereby agrees to indemnify and hold Evermore Ridge LLC free and harmless from all liability for any such loss, damage or injury to other persons, and from all costs and expenses arising there from, including but not limited to attorney fees. Evermore Ridge LLC requires the CLIENTs credit card to be placed on file, which will be charged if the CLIENT, guests, invitees, employees or other agents under the CLIENT’s control are on Evermore Ridge LLC property outside of rental duration hours. The credit card on file will be charged for excessive clean up, clean-up of bodily fluids or the cost to cover damages done to the property by the CLIENT, their guests, invitees, employees or other agents under the CLIENT’s control. The property of Evermore Ridge LLC includes but is not limited to, the grounds, landscaping, fencing, building, equipment, fixtures, décor, and furniture. I have read and agree with Evermore Ridge LLC guest policies and liability waiver. This includes if you are the parent or guardian of a minor who is attending an event at Evermore Ridge LLC with you. By signing this agreement, you fully understand and voluntarily agree to all of the terms and conditions set forth herein.

By submitting the required information and executing this agreement electronically, you hereby acknowledge and affirm your understanding, acceptance, and agreement to be legally bound by all terms and conditions set forth herein.
